Homosexuality Hate Crime Ruling

It is a sad day in Canada. There has been a ruling in the Human Rights Commission that declares a pastor, who spoke out publicly against homosexuality, as committing a hate crime. See the World Net Daily article.

Now, this ruling is baffling to me, because it goes directly against our law in Canada. Observe...

First off, in Section C-46 (Hate Propaganda) of the official Canadian Criminal Code, we read the following...

Definition of "identifiable group"

(4) In this section, "identifiable group" means any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation

Public incitement of hatred

319. (1) Every one who, by communicating statements in any public place, incites hatred against any identifiable group where such incitement is likely to lead to a breach of the peace is guilty of

(a) an indictable offence and is liable to imprisonment for a term not exceeding two years; or

(b) an offence punishable on summary conviction.

Wilful promotion of hatred

(2) Every one who, by communicating statements, other than in private conversation, wilfully promotes hatred against any identifiable group is guilty of

(a) an indictable offence and is liable to imprisonment for a term not exceeding two years; or

(b) an offence punishable on summary conviction.

Defences

(3) No person shall be convicted of an offence under subsection (2)

(a) if he establishes that the statements communicated were true;

(b) if, in good faith, the person expressed or attempted to establish by an argument an opinion on a religious subject or an opinion based on a belief in a religious text;

(c) if the statements were relevant to any subject of public interest, the discussion of which was for the public benefit, and if on reasonable grounds he believed them to be true; or

(d) if, in good faith, he intended to point out, for the purpose of removal, matters producing or tending to produce feelings of hatred toward an identifiable group in Canada.

So, we see, according to the LAW of our land, it would essentially be illegal to rule that Stephen Boisson is guilty of hate propaganda, for the following reasons...

  1. It is his religious belief, based on a well known religious text. This is clear beyond imagining.
  2. He was in no way in a position to cause a breach of the peace.  It was written in the news paper.
  3. He did not in any way promote hatred toward homosexuals.  He showed the depravity of the militant homosexual agenda, and even expressed love for the individual homosexuals.

Also, I think it's important to remember that Stephen was in NO WAY propogating hate, in any way, shape, or form.  I read his letter in the Red Deer paper, and it was completely reasonable, accurate, and had nothing of hate.  He never once indicated that he hated homosexuals (nor should we).  He only voiced his views that being gay was a sin, and that the homosexual organizations (not the inviduals) were militant.  And, that's true.  One of the organizations even goes as far as to say "sex before eight or else it's too late".

Adultery or fornication of any form is a sin.  Would you find a white-male complaining to the Human Rights Commission if I told them that their adultery was sinful?  Duh, of course not.  Besides, Christians don't go around telling people that we hate them.  At least not true Christians anyhow.

  1. The HRC and the Canadian goverment(I just a similar thing about Brigitte Bardot last week on BBC’s news site.She was fined $23,00 for stating that the European gov. are giving too much favour to Islam and Moslems!)…

    I just read today in Macleans of how an author and the Magazine have been taken to court over their review of his book “America Alone” and some “facts” he stated about Islam….also at stake is their refusal to allow(an Islamic group?)another group to write and have published a 5,000 word rebuttal!

  2. An update on this.

    Steve Boissoin has won the appeal, and is not guilty of what he was charged with. His words fall clearly within free speech.
